A Nigerian man, Obina Christopher Ezeoke, has won a human rights case in the UK after arguing that his rights were violated due to the excessive delay in bringing his case to trial.

Ezeoke was convicted of murdering two people, Bervil Kalikaka-Ekofo and Annie Ekofo, in 2016 and was sentenced to life imprisonment with a minimum term of 40 years.

 

The European Court of Human Rights (ECHR) ruled that the prolonged legal process, which included five trials over five years, constituted a breach of Article 6 of the European Convention on Human Rights.

The court acknowledged that most of the delays were beyond the control of UK courts or the government, but still found that the overall length of proceedings violated Ezeoke’s rights.

 

The delays in Ezeoke’s case were caused by a series of unfortunate events, including the illness of a judge, hung juries, and the COVID-19 pandemic. Despite these exceptional circumstances, the ECHR found that the UK government had failed to ensure that Ezeoke’s case was heard within a reasonable time.

 

The ECHR’s ruling has been met with criticism from some UK officials, who argue that it undermines the integrity of the UK’s justice system. Shadow Justice Secretary Robert Jenrick called the ruling “judicial activism,” and expressed concerns about the potential consequences for victims of crime.

 

However, human rights advocates have welcomed the ruling, arguing that it upholds the fundamental right to a fair trial within a reasonable time. The case highlights the difficult balance between upholding defendants’ rights and ensuring justice for victims of serious crimes.

Ezeoke remains incarcerated in a high-security prison, serving his life sentence for the double homicide. While the ECHR’s ruling does not overturn his conviction or sentence, it does provide a measure of vindication for Ezeoke, who has maintained that his rights were violated throughout the prolonged legal process.
